The Breakdown of a Spousal Relationship

Going through the breakdown of a spousal relationship is difficult and our family law lawyers are here to help. Our family law lawyers can assist with a marriage breakdown or the breakdown of a common-law spousal relationship.

Only those who have been legally married are required to be divorced. It is not necessary to prove that one spouse is at fault in order to be granted a divorce. In fact, most divorces are granted simply upon the basis that the parties have lived separate and apart for more than one year. Though common-law spouses do not need to get divorced, there may still be issues related to division of property, parenting, child support and/or spousal support that a family law lawyer or divorce lawyer can assist with.

Family Property Division

When a spousal relationship ends, the family property of the parties must be divided. Family property means an asset owned by both spouses or either of them. The family debt must also be accounted for and allocated. Presumptively, both spouses are entitled to an equal division of the family property, though exemptions, exceptions and other equitable considerations may apply. Parenting

When parents decide to separate, parenting arrangements must be put in place regarding the care of any children involved.
